1. Acceptance of Terms
These Terms of Service (“Terms”) govern your use of the BIQE
handwritten text recognition SaaS at ocr-handwriting.online
(the “Service”), operated by BIQE V.O.F. (“we”, “us”, “our”,
“BIQE”).
By creating an account or by using the Service, you (“Customer”) agree to these Terms. If you do not agree, do not use the Service.
These Terms apply alongside our Privacy Policy, which forms an integral part of this agreement.
2. Definitions
- Customer — the legal entity (organization) that holds an account.
- User — an individual person authorized to access the Service through a Customer account (e.g. an employee or contractor).
- Service — the BIQE web application and API at
ocr-handwriting.online, including the OCR/HTR processing pipeline. - Job — a single scan-processing task submitted to the Service.
- Page — a single image submitted as part of a Job; the unit on which billing is based.
- Tier — the processing quality level chosen for a Job (Cheap, Balanced, or Best), each with different pricing and underlying models.
3. Account Registration and API Keys
3.1 Account setup
We create a Customer account for your organization upon agreement. The primary contact you provide becomes the account owner and may invite additional Users.
3.2 Account security
You are responsible for: - Keeping login credentials confidential -
Notifying us promptly at info@biqe.biz if you suspect
unauthorized access - Ensuring your Users comply with these Terms
3.3 API keys
The Service supports programmatic access via API keys. You must: - Treat API keys as secret credentials - Rotate them if you suspect they have been exposed - Not share them outside your organization
We are not liable for use of the Service by anyone in possession of your credentials, regardless of how they obtained them.
4. Description of Service
4.1 What the Service does
The Service accepts uploaded scanned images (typically handwritten or historical documents), processes them through a pipeline that includes: - Layout analysis - Handwritten Text Recognition (HTR) - LLM-based correction (per the Tier you select)
It returns recognized and corrected text in the formats you choose.
4.2 Tiers
The Service offers three processing Tiers with different cost, accuracy, and speed trade-offs:
- Cheap — fastest, lowest cost, good for legible scans
- Balanced — default, good quality for most use cases
- Best — highest quality, recommended for difficult or critical material
Tier names, models used, and pricing may evolve over time. Current
pricing is available at /pricing and in the Customer
Portal.
4.3 Service evolution
We may improve the underlying models, add or remove Tiers, and adjust pricing with notice (see §7.4 and §13).
5. User Responsibilities
You agree:
- Lawful use — to use the Service only for lawful purposes
- Right to upload — that you have the legal right to upload the documents you submit (you own them, have permission, or they are in the public domain)
- No prohibited content — not to upload material that is illegal, infringes third-party rights, contains malware, or violates applicable export controls
- No abuse — not to attempt to overwhelm or disrupt the Service, scrape it beyond your account’s intended use, or reverse-engineer its components
- Personal data of third parties — if your scans
contain personal data of identifiable individuals (e.g. genealogical
archives, civil-registry records), you are responsible for ensuring you
have a lawful basis under GDPR or applicable law to process them through
our Service. We act as a data processor in that case; a Data Processing
Agreement (DPA) is available at
/legal/dpa.
We reserve the right to suspend accounts that violate these responsibilities, with notice where reasonably possible.
6. Intellectual Property
6.1 Your content
You retain full ownership of: - The scans (images) you upload - The OCR/HTR results we return to you
We do not claim any rights over your content. We do not use your content to train AI models. We do not share your content with third parties except the sub-processors strictly necessary to deliver the Service (see Privacy Policy §5).
6.2 Our intellectual property
The Service, including the website, software, models, and documentation, is owned by BIQE V.O.F. or our licensors. These Terms grant you a non-exclusive, non-transferable right to use the Service for your own business purposes during your subscription. You may not resell or sublicense the Service without prior written agreement.
7. Pricing and Billing
7.1 Pricing model
The Service uses pay-per-page pricing based on the Tier you select for each Job:
- Cheap: € 0,01 per page
- Balanced: € 0,03 per page
- Best: € 0,08 per page
Prices exclude VAT. Stripe Tax automatically calculates VAT (21% for NL B2C, reverse-charge for EU businesses with a valid VAT-id, local rules for non-EU).
Pricing is current as of the Effective Date and may change with 30 days’ notice (§7.4).
7.2 Pilot credits
New Customers receive 100 free pages as pilot credits, usable across any Tier. Pilot credits are consumed first; only once they are exhausted does paid usage begin. Pilot credits are non-transferable, non-refundable, and have no cash value.
7.3 Billing cycle
- Usage is metered per page processed
- Invoices are issued monthly, covering usage from the previous calendar month
- Payment is collected automatically via the payment method on file (handled by Stripe)
- If a payment fails, Stripe will retry; we will notify you by email after the first retry
- Persistent payment failures may lead to account suspension after multiple failed attempts
7.4 Monthly cap
By default, each Customer has a monthly spending cap to prevent runaway usage. When the cap is reached, the default action is to block further Jobs until the cap resets at the start of the next month, or until you raise it. The cap and action can be adjusted in the Customer Portal.
7.5 Pricing changes
We may change pricing with at least 30 days’ notice by email. If you do not agree with a change, you may cancel under §10 before the change takes effect.
7.6 No refunds for processed pages
Pages already processed are billed and are not refundable, except where required by applicable consumer-protection law.
8. Service Availability
8.1 Best-effort availability
We aim to provide a reliable Service, but we do not currently offer a Service Level Agreement (SLA) with guaranteed uptime, response times, or financial credits for outages. The Service is provided “as is” and “as available”.
8.2 Maintenance and changes
We may temporarily interrupt the Service for maintenance, security patches, or improvements. We aim to give advance notice for planned maintenance affecting customer workflows.
8.3 Beta features
Some features may be marked as beta or experimental. These are provided without any reliability commitment and may be modified or removed.
9. Data Processing and Privacy
Our handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
When you submit Customer-personal-data (i.e. data about identifiable
individuals) for processing through our Service, we act as a
processor and you act as controller
under GDPR. A Data Processing Agreement (DPA) is available at /legal/dpa.
Sub-processors are listed in the Privacy Policy §5. We will give reasonable advance notice of changes to the sub-processor list.
10. Termination
10.1 Termination by Customer
You may close your account at any time through the Customer Portal or
by contacting us at info@biqe.biz. There is no minimum
subscription term unless separately agreed in writing.
10.2 Termination by us
We may suspend or terminate your account if: - You materially breach these Terms (including non-payment after reminders) - We are required to do so by law - The account has been inactive for more than 12 months (with prior notice)
10.3 Effect of termination
Upon termination: - Access to the Service ends - Outstanding invoices remain payable - Your scan files are deleted per the standard 30-day retention (Privacy Policy §4) - We retain billing records for 7 years per Dutch fiscal law
You can export your data through the Customer Portal before termination.
11. Limitation of Liability
11.1 Service provided “as is”
The Service is provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by mandatory consumer-protection law.
11.2 OCR/HTR accuracy
HTR is inherently probabilistic. We do not warrant that recognition results will be 100% accurate. You are responsible for reviewing results before relying on them for legal, archival, or other consequential decisions.
11.3 Liability cap
To the fullest extent permitted by law, our total cumulative liability for any claim relating to these Terms or the Service is limited to the amount you paid for the Service in the 12 months preceding the event giving rise to the claim.
11.4 Excluded damages
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data (beyond restoration from your own backups), or business interruption — even if advised of their possibility.
11.5 Mandatory law
Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, death or personal injury, or any other liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold us harmless from claims by third parties arising out of: - Content you upload that infringes their rights - Your breach of these Terms - Your violation of applicable law (including GDPR obligations as controller of the personal data you submit)
13. Changes to these Terms
We may update these Terms from time to time. For material changes (e.g. changes to pricing, scope, or your rights), we will: - Notify active Customers by email at least 30 days before the change takes effect - Update the “Last Updated” date at the top of these Terms
If you do not agree with a material change, you may terminate your account before the change takes effect, per §10.
For non-material changes (typo fixes, clarifications), we update the date without separate notice.
14. Governing Law and Disputes
14.1 Applicable law
These Terms are governed by Dutch law, excluding its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
14.2 Jurisdiction
Any dispute arising out of or relating to these Terms or the Service is subject to the exclusive jurisdiction of the competent court in the district of Overijssel, the Netherlands, without prejudice to mandatory consumer-protection rules that may grant additional rights in your country of residence.
14.3 EU consumers — out-of-court dispute resolution
EU consumers may also use the European Commission’s Online Dispute

15. Miscellaneous
15.1 Entire agreement
These Terms (together with the Privacy Policy and any DPA) constitute the entire agreement between you and BIQE V.O.F. regarding the Service, and supersede prior agreements on the same subject.
15.2 Severability
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
15.3 No waiver
Our failure to enforce a provision is not a waiver of our right to enforce it later.
15.4 Assignment
You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of substantially all our assets, with notice to you.
15.5 Force majeure
Neither party is liable for delays or failures caused by events beyond reasonable control (natural disasters, war, sub-processor outages we cannot mitigate, government action, etc.).
